Terms and Conditions
Agreement Definitions and Occupancy: For the purposes of this agreement, the person in whose name the reservation is made, and/or the cardholder (or person(s) making payment), as well as any persons identified at the time the reservation is made are individually and collectively considered to be the “guest” or “guests”. The guests are responsible for the terms of the agreement and are obligated to uphold the responsibilities in the rental agreement (e.g. payment, compliance with laws and our rules, appropriately caring for the property, etc.). The term “guest” may also refer to any person or persons who visits or occupies the property during the rental term (including the cardholder), whether staying overnight or not, and is the sole responsibility of the person in whom the reservation is held. At no time can the collective number of persons exceed the occupancy as advertised for the property. Furthermore, the guests agree and acknowledges that the number of occupants identified at the time the reservation is made is true and correct. It is the responsibility of the guests to notify Select Vacation Properties of any changes to the number of adults, children, guests or visitors. If at any time the number of persons exceed the occupancy as advertised for the property, this violates the conditions of the agreement, and Select Vacation Properties reserves the right to cancel the remaining term of the agreement and retain all pre-paid funds. Any persons on the property who are not identified in the reservation, or on the property at any time without the expressed written consent of Select Vacation Properties are considered to be trespassing.
Payment Terms: All reservations will require a minimum initial down payment of $500.00 at the time of booking. For reservations over $5,000, the minimum required down payment is 10% of the reservation amount. The remaining balance for all reservations is due 60 days prior to arrival. Please make checks payable to: Select Vacation Properties and mail to 2449 Periwinkle Way, Sanibel, Florida 33957. Please include your reservation number on all checks and correspondence. If payment has not been received by the due date, SVP will attempt to automatically charge the card on file for the balance due. If we are unable to process the payment within 48 hours of the due date SVP reserves the right to cancel the reservation and retain all pre-paid funds. Refunds or adjustments cannot be made for late arrival or early departure. Credit card payment processing is done by Yapstone, Inc., 2121 N. California Blvd., Suite 400, Walnut Creek, CA 94596. These payment services may include money transmission services, pursuant to licenses held by Yapstone. Security Deposit/Damage: Select Vacation Properties requires a refundable security deposit for every reservation, except in cases where the guest has purchased a Vacation Rental Damage Protection Plan thorugh Select Vacation Properties. The security deposit shall be retained to cover any costs associated with damage to the property, costs of additional cleaning, repairing or replacing any lost or broken items or contents, or lost rental income or related expenses due to damage or cleaning. If the deposit is insufficient to cover damages, guest agrees to pay any additional costs on demand. By agreeing to these terms and conditions, the cardholder is authorizing SVP to charge the credit card on file for any unpaid balances, additional expenses or damages to the rental property not resulting from normal wear and tear, excessive cleaning charges, long-distance phone charges and time or labor costs et al. If all terms and conditions of this contract are fulfilled and there are no additional charges, or if additional charges are less than the full amount of the deposit, then any refund due will be processed within 14 business days after departure date. For stays of 28 days or more, security deposit refunds will be processed within 30 days after departure date.
Vacation Rental Damage Protection: As a part of your stay, you may purchase a Vacation Rental Damage Protection plan designed to cover unintentional damages to the rental unit interior that occur during your stay provided they are disclosed to management prior to check-out. If purchased, the policy will pay a maximum benefit of $5,000. Any damages that exceed the Policy Limit or are not covered under the plan will be charged to the credit card on file. If, during your stay at one of our rental properties, an insured person causes any damage to real or personal property of the unit as a result of inadvertent acts or omissions, the Insurer will reimburse the Insured for the cost of repair or replacement of such property up to a maximum benefit of $5,000. Certain terms and conditions apply. Full details of the Vacation Rental Damage coverage are contained in the Description of Coverage or Insurance Policy at ?product=G-20VRD. The Vacation Rental Damage can be purchased up to, and including at, check-in. By submitting payment for this plan, you authorize and request Customized Services Administrators, Inc. d/b/a Generali Global Assistance & Insurance Services to pay directly Select Vacation Properties any amount payable under the terms and conditions of the Vacation Rental Damage. Please contact Select Vacation Properties directly if you do not wish to participate in this assignment.
Cancellation Policy: All cancellations are to be made in writing, and the legally binding cancellation date is the date that notice is received by Select Vacation Properties. We are always happy to provide a full refund for cancellations which occur within 48 hours of booking. If cancellation occurs more than 90 days from arrival date, then we are happy to refund the deposit less an administrative fee equal to 25% of the deposit amount plus tax. If cancellation occurs within 90 days of your arrival date SVP will retain all prepaid funds unless the property is re-rented for the same dates and rate less cancellation fees and costs to re-book. We strongly recommend purchasing our optional travel insurance. SVP is not responsible for loss of deposits or payments due to cancellations, and optional trip cancellation coverage is the only remedy for recovering funds due to cancellations.
Check-In: The check-in process begins at 4 p.m. We are happy to accommodate early arrivals whenever possible, however please refrain from making your travel plans around an early check in, as early check-ins are a courtesy and not guaranteed. Please check in at our office, 2449 Periwinkle Way, The Baileys Center, Sanibel, FL 33957. Should you arrive after 5 PM, your keys, directions to your property and check-in package will be placed in our lockbox, located to the left of our office door. The combination is provided with the reservation confirmation documents.
Check-Out: Checkout will be promptly at 10 a.m. If you would like a late check out or wish to extend your stay, please contact our office at least 24 hours prior to your check-out date and time. Late check-out cannot be guaranteed and is available only as circumstances allow. If your present accommodations are available, we would be happy to provide a rate quote.
Unforeseen Circumstances: There are many things that we can control but two that we cannot are weather and construction. No refunds or discounts will be given for cancellation or interruption that occurs due to inclement weather. And again, we highly recommend purchasing Travel Insurance (restrictions apply). Because tourism is the largest industry on Sanibel and Captiva Islands, there is often construction going on. Should you find yourself near construction, please exercise patience and understanding. In the event it becomes intolerable, we will do our best to talk to the contractors, however SVP cannot guarantee any refunds or moves.
Confirmation: Reservations are not considered confirmed until a representative from SVP has verbally confirmed the booking and taken a deposit. Deposits, service fees or verbal assurances from third-parties, online travel agencies or booking websites are not considered confirmation. Should it be necessary, SVP reserves the right to adjust, change or cancel any reservation at any time.
Substitution of Accommodations: Occasionally, it may be necessary to provide an alternate property in lieu of the originally booked property. Select Vacation Properties has the exclusive right to determine when a substitution is to be made, and what constitutes a comparable property. In the event a substitution is deemed necessary by SVP, its employees or assigns, we reserve the right to substitute accommodations and make rate adjustments at our sole discretion. Substitute properties are only available from other properties within the portfolio we manage.
Care and Maintenance: It is the guest's responsibility to keep the rental premises clean during the specified rental period, and to be responsible for any damage caused by abuse or neglect. All maintenance items should be reported to SVP as soon as they are found to exist. Failure to notify us of a problem or defect in a timely manner releases SVP from future claims from unreported issues. SVP will make every reasonable effort during the normal course of business to correct or repair items of maintenance in a timely manner but makes no warranties for such.
Pets/Service Animals: Pets are not permitted in any rental property unless otherwise specifically stated in writing. If you would like to bring a pet, SVP will make every reasonable effort to accommodate you in a pet-friendly property but cannot guarantee the availability of these units. In all properties where pets are accepted, a non-refundable pet fee will be charged to your reservation. With regard to ADA compliant service animals, it should be noted that vacation rentals are considered private property and are exempt from the same rules and regulations that commercial properties must follow with regard to allowing ADA compliant service animals. It should also be noted that as of 2011, only dogs are recognized as service animals by the ADA. With that being said, we understand the difficulties of those with special needs when it comes to travel, and we will make every effort to accommodate you and your service animal, or refer you to other properties, agencies or services who can in the unlikely event we cannot. Emotional support animals, comfort animals, and therapy dogs are not service animals under Title II and Title III of the ADA. Other species of animals, whether wild or domestic, trained or untrained, are not considered service animals. If you plan to travel with a comfort animal, we will make every reasonable effort during the normal course of business to pair you with a property where your animal is accommodated, and a non-refundable fee will be charged to your reservation. It is important to note that the non-refundable pet fee is NOT a damage deposit. All damage caused by any animal, whether ADA service animal, pet or therapy animal is an additional charge, and will be billed to the credit card on file.
Smoking: All of our properties are non-smoking. Some properties may allow smoking in designated public outdoor or common areas. This is subject to change. Please speak to an SVP representative for the current smoking regulations for your specific property at the time of your rental.
Furnishings: All rental properties are individually owned and decorated according to the owner’s taste. The property décor may be changed from time to time by the owner or due to owner exchanges. While we make every reasonable effort during the normal course of business to keep our photos and descriptions current, these can change without notice. In cases where properties are booked months in advance, the property representations at the time the reservation is made may not reflect the condition of the unit at the time the rental commences.
Guest Behavior: The guest is responsible for the behavior of all members of the party, group, guests or visitors during the term of the stay. Behavior should not be excessive, noisy, disruptive, and should be consistent with the rules and regulations of the association (if any). Offensive or illegal behavior will not be tolerated, and no refunds or compensation will be given in these circumstances, and we reserve the right to decline future reservations.
Force Majeure: Select Vacation Properties shall not be liable for damage or injury, closure, delay or default, if such event is caused by conditions beyond our control, including, but not limited to, weather conditions, acts of God, animals or insects, flora, force majeure, strikes, civil commotions, embargoes, terrorism, wars or other hostilities, whether actual, threatened or reported, and/or any other cause beyond the reasonable control of Select Vacation Properties, its employees, principals, successors or assigns.
Travel Insurance: Travel insurance through CSA Travel Protection is made available by Select Vacation Properties as a convenience to our guests. Select Vacation Properties is not affiliated with CSA Travel Protection, and we do not underwrite insurance either individually or with third party vendors, nor do we guarantee the accuracy or quality of their services. Although we may promote and/or recommend the services offered by CSA, this is just one of many travel insurance companies in the marketplace, and individuals are encouraged to research other options to find the coverage which best fits their individual needs. All persons are ultimately responsible for understanding the services they purchase, and are solely responsible for understanding the exclusions, limitations and coverages.
Amenities: Amenities vary at each property and these are considered complimentary and are not guaranteed. The rent paid is consideration only for the use of the property during the rental period and does not include or guarantee the existence or use of additional items of personal property or amenities. All representations or references to items of personal property located in the rental property should be considered as a list of what is typical, not what is specifically existing or guaranteed. Please contact SVP regarding specific amenities you may desire. It is not guaranteed that pools are heated, however if they are heated the association determines the pool temperature as well as the dates that heat is available. For residences with private pools, the tenant is responsible for electric bill charges over $400 per month. Upon arrival, the pool temperature is set to a value intended to keep the monthly electric bill at or below this threshold. Increasing the pool temperature will be construed as consent to pay any charges over $400 per month.
Entry of Premises: SVP maintains the right for any authorized employee or repairperson to enter the premises for any purpose related to the repair, improvement, care, and management of the premises.
Student Groups: Anyone under 21 years old must be accompanied by a parent and/or guardian. Reservations obtained under false pretenses will be subject to forfeiture of all amounts paid and the party will be not permitted to occupy any unit in our Rental Management Program.
Causeway Tolls: There is a $6.00 round trip charge to access Sanibel and Captiva Islands, SVP does not reimburse for toll charges.
Co-Brokered and/or Sub-Leased Properties: In cases where SVP has secured a rental property on behalf of a lessee or guest through another agency or third-party, lessee agrees to abide by all terms and conditions of SVP as well as those of the aforementioned agency or third-party provider. In these co-brokerage arrangements, payment terms, cancellation policies and other conditions may differ from those set forth in this document, and lessee acknowledges and agrees. Furthermore, it is expressly stated that in all co-brokered or multiple agency agreements, the more restrictive policy or interpretation of policy shall in all cases apply, and lessee acknowledges and agrees. It is the responsibility of the lessee and guests to read and understand the terms and policies in effect as of the dates of occupancy of all co-brokering agencies or third parties, and SVP does not, interpret, warrant or provide any information pertaining to third party policies, rules, regulations or conditions.
Liability Waiver and Hold Harmless Agreement: In full consideration of, and in exchange for the right to occupy the property during the specified rental period, the undersigned guest agrees to release, waive, discharge and hold harmless Select Vacation Properties, their principals, officers, agents, or employees as well as the owners of the properties we represent from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of, or related to any loss, damage, or injury, including death, that may be sustained by the cardholder, guests, visitors, or family member, or to any property belonging to the aforementioned, while staying in the property, or on or upon the premises or common areas, or otherwise and regardless of whether such liability arises in tort, contract, strict liability, or otherwise, to the fullest extent allowed by law. For the entirety of this agreement, “cardholder” “guest” and “tenant” are defined equally as: (1) any person making a reservation (2) any person whose name was used at the time the reservation was made (3) any person (or persons) providing consideration in full or part.
Furthermore, acceptance of this agreement is acknowledgement that the guests voluntarily assume full responsibility for any risks of loss, property damage, or personal injury, including death, that may be sustained as a result of being engaged in any activities during the rental period, whether occurring on the subject property or not.
It is the expressed intent that this agreement shall bind the guest, visitors, tenant, family, spouse, guests, heirs, assigns or personal representatives. The guests also agree that that this Liability Waiver and Hold Harmless Agreement shall be construed in accordance with the laws of the State of Florida and that any mediation, suit, or other proceeding must be filed or entered into only in Florida and the federal or state courts of Florida. Any portion of this document deemed unlawful or unenforceable is severable and shall be stricken without any effect on the enforceability of the remaining provisions.
PAYMENT OF DEPOSIT IS CONSIDERED BY BOTH PARTIES TO BE LEGALLY BINDING, UNCONDITIONAL ACCEPTANCE OF THESE TERMS AND CONDITIONS, and the guests acknowledge and state that the foregoing Wavier of Liability and Hold Harmless Agreement is understood and agreed to voluntarily; and no oral representations, statements, or inducements, apart from the foregoing written agreement, have been made. Furthermore, the primary guest and cardholder is at least eighteen (18) years of age and fully competent; and this agreement is executed for full, adequate and complete consideration.
Emergencies: Select Vacation Properties is available after normal business hours for property related emergencies. Please call our office and our answering service will be happy to assist. For medical emergencies, please dial 911.
Parking: Parking at all rental properties is for automobiles only. Motor homes, boat trailers, jet skis, pickup trucks, etc. are not permitted unless otherwise stated specifically in writing.
Mail: If you wish to receive mail during your vacation please have it sent to you in care of SVP at 2449 Periwinkle Way, Sanibel Island, FL 33957. Please refrain from having mail sent directly to your rental property.
